Beach Rules
CBA MEMBER USE
Only CBA owners, their family and house guests, or rental tenants can use the beach, doing so at their own risk. Please advise your guests/renters* of beach rules. You are responsible for your family, guests' or renters' behavior. All visitors to CBA Beach property must be accompanied by a member or have a gate key FOB on their person. Conveyance of CBA Member privileges to a non-member is not legal and will not be allowed at any time for any reason.
CBA BEACH INDEMNIFICATION
The use of the CBA Beach and all related activities are at the sole risk of each CBA Member utilizing a CBA procured key for access. This includes all guests and all tenants*.
The CBA Board of Directors must have a valid CBA Beach Indemnity and Hold Harmless Agreement signed by the CBA Member in our files. You are not allowed access to the beach or a key to the gate unless we have a current Agreement covering your property.
ACCESS AND GATES
Unless cars are driving in and out, please keep gates closed for the safety of children and dogs. LOCK ALL GATES WHEN LEAVING THE BEACH.
CAR AND PARKING
No motorized vehicles are allowed beyond NO PARKING SIGN for any reason. The beach is considered a sea turtle preservation area. No vehicles allowed on the premises after 10:00 PM.
PRIVATE PROPERTY RIGHTS WILL BE RESPECTED AT ALL TIMES
It is illegal to damage or destroy any private property which includes chairs, picnic tables, tiki-huts, gate, gate access points, security cameras, trees and/or vegetation.
ILLEGAL SUBSTANCES
All illegal substances, as defined by federal laws, are prohibited from use in the CBA Beach Property. Members, their children, and/or their guests who bring illegal substances onto the premises, or who are observed consuming illegal substances, or who arrive at the beach property under the influence of illegal substances, or who leave indicators of illegal substance use will have their membership revoked immediately.
21 YEARS OR UNDER USE
Children of members under 21 must have parental consent to use the beach and no one under 21 is allowed on the beach after 10:00 PM unless accompanied by a parent of CBA property owner. No loud, lewd and dangerous behavior, NOR UNDERAGE DRINKING will be tolerated. The police will be notified.
Minor children, age 12 (twelve) and under, must be accompanied at all times by an adult guardian who is a member. Members are responsible for the actions of their children and all guests, at all times.
PRIVATE USE AND/OR PARTIES
The CBA Beach premises cannot be reserved for private parties. You may want to post a sign on the beach gate or on the CBA website under the reservation a week before planning a large party to let other members know, however, the beach cannot be closed to the rest of the CBA members. Parties, picnics or gatherings held on the beach or common areas consisting of more than 20 non-members per property shall require written approval from the Board of Directors. Members are responsible for the actions of their guests, and must abide by Beach Rules at all times.
CHAIRS/TABLES
Bring chairs back to high ground after use. Clean tables after use and please keep tables located under tiki hut.
GLASS RESTRICTIONS
Glassware and glass containers are prohibited on the beach.
OPEN FLAME
NO BONFIRES - FIRE-PITS - FIREWORKS - TORCHES OR OTHER OPEN FLAME, per county and CBA. Police and Fire Dept. will be notified.
TRASH REMOVAL
CBA DOES NOT have trash removal for the beach. Removal of all litter is the responsibility of each individual. ALL GARBAGE AND RECYCLABLES MUST BE BROUGHT HOME WITH YOU.
DOGS
Dogs are allowed to be off-leash on the beach as long as the dog is under the owner’s immediate control. If other CBA members are at the beach, dogs must remain on-leash unless agreed upon by all parties. CBA mandates feces be picked up properly and removed from the beach when exiting the property. Do not bury feces in the sand.
NOISE ORDINANCE
CBA follows the Siesta Key noise ordinance, which is:
"NOISE ORDINANCES: Siesta Key and surrounding areas do have noise ordinances with which all occupants and guests must comply. Noise ordinances go into effect at 10:00 pm and pertain to loud music, loud voices, or other loud sounds coming from a property after 10:00 pm."
CANCELLATION OF MEMBERSHIP
The board reserves the right without refund of any payment to suspend or revoke membership privileges of anyone violating these rules. This includes resident and non-resident members and guests. Revocation of membership may be for one day, one week or entire year or for life. Decisions may be appealed at a regular meeting of the Board of Directors.
ADDITIONAL RULES – The board may put into effect, at any time, rules that are considered of benefit to the beach property, and its members.
